3. Booking and Reservations

3.1 Booking Process

The charter reservation process mandates that you:

• Have reached the age of majority, which is 18 years
• Submit precise and comprehensive personal details
• Remit the preliminary deposit as indicated in the booking acknowledgement
• Accept the terms laid out in these Terms & Conditions

3.2 Confirmation

Confirmation of your reservation occurs upon successful payment and issuance of our written confirmation. We retain the discretion to decline services to anyone.

3.3 Availability

Charter reservations hinge on the accessibility of our fleet and the presence of safe meteorological conditions. We shall endeavor to accommodate your requested dates and times to the best of our capability.

4. Payment Terms

4.1 Pricing

Pricing for our services is quoted in € and incorporates all relevant taxes, unless specified otherwise. Prices are susceptible to alterations without prior notice.

4.2 Payment Schedule

• Deposit: Half of the entire charter cost to be paid upon booking
• Balance: To be settled 48 hours preceding the departure of the charter
• Additional charges (if applicable): Payable after the charter concludes

4.3 Payment Methods

Payments are accepted through major credit cards, bank wire transfers, and certified bank drafts. Transactions are processed employing secure, encrypted protocols.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

• If cancellation occurs more than 72 hours prior to departure: a full refund minus processing fees is issued
• If cancellation is made 24-72 hours before departure: a 50% refund is granted
• If cancellation is less than 24 hours before departure: no refund is provided

5.2 Weather Cancellations

In instances where our captain deems weather conditions to be hazardous, we will propose to:

• Reschedule the charter to an alternate available date without additional costs
• Issue a complete refund if rescheduling cannot be accommodated

5.3 Mechanical Issues

Should mechanical trouble arise with the yacht allocated to your reservation, we will strive to supply an acceptable alternative. In the absence of a substitute, a complete refund will be rendered.

6. Safety and Conduct

6.1 Safety Requirements

All guests are required to:

• Heed all directions issued by the crew
• Utilize prescribed safety gear when instructed
• Disclose any medical conditions that could impact their security
• Remain within approved areas on the vessel

6.2 Prohibited Items

The following items are forbidden on board:

• Containers made of glass
• Unlawful substances
• Weapons or firearms
• Excessive amounts of beverages (beyond what is considered reasonable consumption)
• Pets, unless pre-authorization has been obtained

6.3 Conduct

Behavior of passengers must be courteous and respectful at all times. We retain the authority to end a charter prematurely without issuing a refund should a passenger's demeanor be deemed a threat to safety or disruptive to other individuals.

7. Liability and Insurance

7.1 Our Liability

We limit our liability to the cost of your charter fee. Our responsibilities do not encompass:

• Injuries to persons resulting from their own imprudence
• The loss of, or damage to, personal belongings
• Derivative, indirect, or punitive losses
• Postponements due to environmental factors or situations beyond our influence

7.2 Insurance Coverage

We maintain inclusive insurance that covers both our marine operations and vessels. Patrons are accountable for securing their travel and personal insurance policies.

7.3 Assumption of Risk

By participating in any charter services, you acknowledge the inherent risks associated with maritime endeavors and assume full liability for your personal health and safety.

8. Modifications and Itinerary Changes

Should it become necessary, we reserve the authority to alter itineraries, travel routes, or schedules due to climatic conditions, safety concerns, or operational demands. Every feasible effort will be made to provide equivalent alternatives.

9. Force Majeure

Our liability does not extend to postponements, cancellations, or modifications resulting from uncontrollable circumstances, which include, but are not limited to:

• Extreme weather events
• Natural calamities
• Mandates by government authorities
• Closures of ports
• Vessel malfunctions
